Terms of Service

1. Introduction and acceptance

Calen is a personal finance organization platform operated by VINICIUS FREIRE BISPO SERVIÇOS ADMINISTRATIVOS LTDA ("Calen", "we"). These Terms of Use govern access to and use of Calen's mobile apps, web app, and website, in accordance with the Consumer Protection Code (Law No. 8,078/1990) and the General Data Protection Law (Law No. 13,709/2018 — "LGPD").

By creating an account or using Calen, you state that you have read, understood, and agree to these Terms and to our Privacy Policy, which is an integral part of this document. If you do not agree, do not use the service.

3. What Calen does — and what it isn't

Calen offers, among other features:

Calen is not a financial institution and never moves money under any circumstance. Every financial transaction happens exclusively through your bank's own channels. Calen also does not provide financial, investment, or tax advice — the analyses, projections, categorizations, and assistant answers are purely informational, may contain inaccuracies, and do not constitute professional recommendations. Data shown is obtained from financial institutions through third parties and may be delayed or inconsistent; confirm information with your institution before making important decisions.

The connection to financial institutions is made through Pluggy, in read-only mode: Calen does not carry out transactions, transfers, or any movement on your behalf. Your banking credentials are processed by Pluggy, under Central Bank rules — they never pass through Calen's servers and are not stored by us. You can revoke authorization at any time by disconnecting the institution within the Platform (Connections) or through your bank's own channels.

6. Plans and subscriptions

Access to Calen is through a paid subscription, in the Personal, Plus, and Pro plans (monthly or annual billing), which differ in limits such as the number of Open Finance connections and financial profiles. Current features and prices are shown on the plans screen in the app before purchase.

8. Refunds and right of withdrawal

Since payment is processed by Apple or Google, refund requests are reviewed and processed by the respective Store. On iOS, use reportaproblem.apple.com, and on Android use the Google Play refund center, subject to Store policy and applicable law.

Article 49 of the Consumer Protection Code guarantees a right of withdrawal within 7 (seven) calendar days of the purchase, with a full refund — this right cannot be waived by contract. If a request made to the Store within the legal deadline is not honored, write to contato@usecalen.com.br with the subject "Arrependimento CDC" and we will guide you through exercising this right.

9. AI Assistant

The Calen Assistant uses language models provided by Anthropic (United States). When you ask a question, the assistant may query your financial data (transactions, balances, categories, goals) to formulate the answer. Answers are generated by artificial intelligence, may contain errors or inaccuracies, and do not constitute financial advice. Conversation history is stored by Calen and can be deleted by you at any time. Under Article 20 of the LGPD, you can request a review of automated decisions — details in the Privacy Policy.

10. Availability and maintenance

We work to keep the Platform continuously available, but interruptions may occur due to scheduled maintenance, security updates, failures in integrations with partner financial institutions, or force majeure events. We do not guarantee uninterrupted availability.

Calen — including its brand, design, code, and content — is the property of the operator or its licensors, protected by intellectual property law. You receive a personal, limited, revocable, and non-transferable license to use it, valid while your account is active. Copying, modifying, distributing, or creating derivative works without express authorization is prohibited.

13. Limitation of liability

The Platform is provided "as is." To the extent permitted by law, we are not liable for financial decisions made based on the information shown, for inaccuracies in data originating from financial institutions or partners, for temporary unavailability of the service, or for indirect damages. Our total liability is limited to the amount you paid in the 12 months prior to the event.

Note: these limitations do not apply to cases of willful misconduct, gross negligence, violation of personal data protection duties, or other cases where the CDC or the LGPD prohibit excluding or limiting liability.
